Customer: the person who books a room at Casa Spa d'Alma Portugal, for himself and/or others.
These
general
terms
and
conditions
apply
to
all
agreements
between
Casa
Spa
d'Alma
and
the
client,
unless
explicitly deviated from in writing.
Article 1 - Formation of an agreement
1.1
An
agreement
between
Spa
d'Alma
and
the
client
is
entered
into
through
the
client's
acceptance
of
the
offer
made
by
Spa
d'Alma.
The
agreement
is
valid
from
the
moment
the
client
has
received,
either
by
e-mail
or
in
writing,
confirmation
of
the
booking
from
Spa
d'Alma,
unless
the
booking,
based
on
availability,
has
been
directly
authorised.
1.2
Spa
d'Alma's
offer
is
determined
by
the
details
as
published
on
its
website
or
in
other
publications
of
offers
by
Spa
d'Alma.
Obvious
mistakes
or
errors
in
a
publication
do
not
bind
Spa
d'Alma.
Spa
d'Alma
accepts
no
responsibility
for
publications
such
as
photographs,
texts
and
folders
issued
under
the
responsibility
of
third
parties.
1.3
If,
upon
concluding
the
agreement,
the
client
expresses
certain
preferences
regarding
the
services
to
be
provided
by
Spa
d'Alma,
these
will
be
taken
into
account
as
much
as
possible.
However,
no
rights
can
be
derived
from this.
Article 2 - Payment
2.1
After
making
a
reservation,
a
deposit
of
at
least
30%
per
room
shall
be
payable
upon
receipt
of
the
availability
confirmation.
Your
reservation
is
only
valid
after
we
have
received
your
payment.
The
down
payment
can
be
made
by bank transfer or Credit Card. If you wish to pay by bank transfer, please let us know at the time of reservation.
2.2
The
remainder
of
the
sum
must
be
paid
no
later
than
6
weeks
before
the
start
date
of
the
holiday.
If
the
contract is concluded within 6 weeks of the day of departure, the entire travel sum must be paid immediately.
2.3
Failure
to
pay
on
time
may,
after
a
one-off
summons,
result
in
cancellation
of
the
agreement
by
Spa
d'Alma.
In
that
case,
the
provisions
governing
cancellation
by
the
client
shall
apply
and
the
part
of
the
travel
sum
already
paid shall be offset against the cancellation costs.
Article 3 - Travel documents and luggage
3.1
The
client
shall
be
in
possession
of
a
valid
passport
upon
departure
and
during
the
holiday.
The
documents
sent
by
Spa
d'Alma
in
advance
must
be
checked
for
accuracy
by
the
client.
Any
changes
shall
be
reported
to
Spa
d'Alma
within 5 days of receipt of this information.
3.2
Spa
d'Alma
cannot
be
held
responsible
in
case
the
client
is
unable
to
participate
in
the
stay
or
treatments,
due
to shortcomings in his travel documents. All related costs shall be borne by the client.
3.3
Spa
d'Alma
shall
not
be
liable
for
any
loss,
damage
or
destruction
of
luggage,
travel
documents
and
travel
items during the stay at Spa d'Alma. The client shall take out the insurance policy(s) mentioned in article 8.3.
Article 4 -
Cancellation by the client
4.1 If a contract is cancelled by the client, the following amounts shall be payable by each client:
Cancellation costs:
-Up
to
1
month
before
arrival,
refund
of
the
down
payment
(30%)
of
the
total
amount,
minus
€15
administration
costs.
-30 to 15 days before arrival 30% of total amount.
-14 to 7 days before arrival 50% of total amount.
-After that, 100% of the total amount.
-Cancellation on day of arrival or no show: The full amount will be charged.
-In case of leaving earlier than agreed the full amount will be charged.
For groups that occupy the accomodation the cancellation fee is as follows:
Up
to
2
months
before
arrival,
refund
of
the
down
payment
(30%)
of
the
total
amount,
minus
€15
administration
costs.
-From 2 months up to 1 month before arrival, no refund of the down payment (30%) of the total amount.
-30 to 0 days before arrival 100% of total amount.
Article 5 - Termination by Spa d'Alma
5.1
Spa
d'Alma
shall
only
be
entitled
to
terminate
the
agreement
due
to
circumstances
of
such
a
nature
that
any
further commitment to the agreement by Spa d'Alma cannot reasonably be required.
5.1.1
If,
when
making
the
reservation,
the
client
provided
incorrect
or
incomplete
information
that
is
contrary
to
the rules applied by Casa Spa d'Alma.
5.2 Spa d'Alma shall immediately notify the client in writing or by e-mail of the termination, stating the reasons.
5.3
In
any
case,
Spa
d'Alma
shall
be
entitled
to
terminate
the
contract,
without
being
held
liable
for
any
damages,
if
in
the
event
of
force
majeure,
which
is
understood
to
mean
abnormal
and
unforeseen
circumstances
beyond
the
control
of
Spa
d'Alma,
the
consequences
of
which
could
not
be
avoided
despite
all
precautionary
measures;
examples of force majeure are political unrest, war, shortages, natural disasters and strikes.
In the event of damage caused by a client's misbehaviour, only this client shall be held liable.
Article 6 - Changes by Spa d'Alma
6.1
Spa
d'Alma
is
entitled
to
alter
the
agreement
in
an
essential
manner
on
the
grounds
of
serious
circumstances,
of
which
the
client
shall
be
notified
immediately.
In
this
case,
the
client
shall
be
entitled
to
cancel
and
reimburse
(the part of) the holiday price already paid.
Article 7 - Liability of Spa d'Alma
7.1
Spa
d'Alma
shall
be
liable
to
the
client
for
the
correct
performance
of
the
obligations
ensuing
from
the
agreement, irrespective of whether these are performed by itself or by any other service providers it engages.
7.2 Spa d'Alma shall not be liable for any damage caused by
shortcomings
in
the
performance
of
the
contract
on
the
grounds
of
circumstances
attributable
to
the
client,
including damage caused by the client's health condition;
acts and influences of third parties not directly involved in the execution of the trip;
circumstances
not
attributable
to
Spa
d'Alma
and/or
not
reasonably
attributable
to
Spa
d'Alma
under
Portuguese
law or socially accepted standards.
7.3
Spa
d'Alma
accepts
no
liability
for
damages
that
would
normally
be
covered
by
travel
and/or
holiday
cancellation insurance.
7.4
Insofar
as
Spa
d'Alma
can
be
held
liable
for
any
damage
suffered
by
the
client,
this
liability
shall
be
limited
to
the amount of the accommodation price already paid.
Article 8 - Client obligations
8.1
The
client
is
obliged
to
behave
as
a
good
client.
If
they
cause
such
hindrance
or
nuisance
as
to
seriously
impede
the
stay
of
other
guests,
or
explicitly
fail
to
comply
with
the
applicable
rules,
they
may
be
excluded
from
further
stay
by
Spa
d'Alma,
without
the
right
to
a
refund
of
the
remaining
days.
All
resulting
costs
shall
be
borne
by the client.
8.2
The
client
shall
be
obliged
to
communicate
any
failure
to
comply
with
the
contract,
observed
by
him
on
site,
to Spa d'Alma or its representative on site as soon as possible in writing and with written confirmation.
8.3
It
is
compulsory
for
the
client
to
take
out
comprehensive
insurance
for
risks
covered
by
a
standard
travel
and
accident insurance policy. Cancellation insurance is recommended.
Article 9 - Complaints
9.1
Any
complaints
that
exceed
the
level
of
a
single
comment
or
observation
should
be
submitted
in
writing
or
in
any
other
suitable
form
as
soon
as
possible
to
the
local
representative
of
Spa
d'Alma
and,
if
applicable,
to
the
service provider concerned, at the destination and/or the location where the complaint arose.
Spa d'Alma will respond to the complaint in question as adequately as possible.
